The Taking
Whatever you were in that moment ends here.
A person is arrested and brought before a magistrate; for Stafford, the magistrate's office is inside the jail. Before any finding, they are in custody.
A deputy decides, in seconds and usually alone, that tonight is a custody and not a summons.
It begins with a light behind you. Or a knock. Or your name read off a screen by someone who has already decided what your name is for.
Whatever you were in that moment — a father late for a shift, a woman two days off her medication, a kid who ran because running is what the body does — that ends here.
Arrest. The point of first contact and the only node on the map that can put hands on you.

Within hours you are taken before a magistrate whose office is inside the jail itself.
A screen. A voice that has already read what the officer wrote about you and will not be reading what you wrote, because you have not written anything, because nobody gave you a pen or a lawyer or an hour.
There is no one beside you whose job is your name. Understand that this is not an oversight. The right to a lawyer attaches later. Later is after this. This — the room that decides whether you sleep at home tonight or lose the next six months — this one happens with nobody on your side of it.
Magistrate. The magistrate is the first judicial officer you meet and the most consequential one you will never remember.

The four localities, in figures

The prosecutor charges, the district court schedules, one public defender's office covers all four localities, and a bondsman keeps the premium whatever happens. The circuit court is the room where the sentence is decided.
The charges are drawn by an office that will almost never have to prove them at trial.
Nine cases in ten never see a trial. So the plea is the sentence, and the plea is made here, in private, against no published standard, by an office that does not report how often it declines to charge, or who it offers diversion to, or what it asked for and got.
One charge became four. Four became seven. And none of the seven were written to be proven — they were written to be counted, because the counting is the offer: sign here and the wall comes down to one brick, refuse and find out how tall we made it.
Prosecutor. The Commonwealth's Attorney is the most powerful actor in the system and the least constrained.

Your first hearing is one name on a morning docket, and the docket does not wait.
Thirty names before yours. The docket is a conveyor and you are on it, and the judge is fair, and it does not matter that the judge is fair, because fairness at this speed is a coin flip performed with dignity.
Your lawyer learned your case in the hallway. Your lawyer learned your name from the file. Your lawyer is good at this and has ninety other people who also need somebody to be theirs, and there is a fee cap that makes reading the whole file an act of charity rather than a job.
District Court. The general district court is where the overwhelming majority of criminal cases in Virginia live and die.

Months. Years. The arithmetic of a life read aloud by someone the voters did not choose and cannot unchoose — ten judges of this circuit, elected by the General Assembly, and the state's own directories do not agree on who chairs them.
Circuit Court. The circuit court is where felonies are tried and sentenced, where appeals from the general district court are heard de novo, and where the sentences that send people from this jail into state prison are imposed.

A building made for a thousand holds twelve hundred.
The Jail Authority board approves the budget; intake, classification, medical, grievances, records, commissary and labor are what the budget buys. This act is the jail as its own records describe it.
RRJA Board. The Authority Board is the governing body of the jail — the entity that hires the superintendent, approves the budget, sets policy, awards vendor contracts, and answers for what happens inside.

Booking takes your clothes, your property and the medication you walked in on.
Stop here. Stop right here. This is the most important moment in this entire story and it is happening in a hallway at the speed of a booking queue.
Because that pen either moves or it does not. And if it does not — if the shift is short, if the line is long, if ninety-five of the people who should be standing in this hallway were never hired — then somebody does not get the medicine they walked in on and the thing that killed them or unmade them was not cruelty.

Classification decides where you sleep, in a building holding more people than it was rated for.

You ask for a doctor by filling out a form, and the asking is charged to your account.

Sixty-three percent. Two out of every three. Not denied. Not reviewed and rejected. Not weighed and found light.
Never put on the scale.

Your daughter's voice costs money.
Not as a figure of speech. There is a rate. It is charged by the minute. Last year the minutes came to approximately one million nine hundred thousand dollars.

The costs move outward: to the family, the children, the caseworker, the landlord, the court's fee schedule, the DMV, the employer, the crisis line, the hospital, and the board that counts the dead. The family was charged with nothing.

You were. Once. For a thing that turned out to be nothing.
And that is now a permanent feature of your housing, and of your children's schools, and of every year of your life after this, and nobody in the system that took your home believes they had anything to do with it.

Court Debt. Court debt is the sentence that never ends.

Unpaid court costs take your licence. The work is still nineteen miles away, and there is no bus.
There is no bus. There has never been a bus. There is not going to be a bus — not between Stafford and Spotsylvania, not between King George and the city, not on this map, not in this region, not in your lifetime at the current rate of decision.
License Loss. A license is not a convenience in this region.

Nobody fires you. The shifts simply stop appearing beside your name.
Nobody fired you, exactly.
You just were not there on Monday. And you were not there on Tuesday. And by Wednesday the schedule had your shift covered by somebody else, and by Friday there was no line on the schedule with your name in it, and no one ever said the word fired and no one ever had to, because at your wage attendance is the contract and there is no clause about magistrates.

Zero. In a facility that medicates two hundred and fifty-nine people.
That is not a gap in service. A gap implies someone was reaching. That is a region that has decided its psychiatric hospital will be a jail, and has funded that decision at a hundred and one dollars and sixty-five cents per person per day.
Crisis Services. The community services board is the public behavioral-health system, and it is the node whose insufficiency explains the jail's psychiatric population.

Hospital. When the jail's medical failures become emergencies, an ambulance comes.

Death Review. When someone dies in custody, the Office of the Chief Medical Examiner determines cause and the Board of Local and Regional Jails conducts a death review.

State corrections, the Parole Board, the Board of Local and Regional Jails, probation, reentry organizations, the General Assembly, the Compensation Board and the vendors set the terms the jail runs under. The four local governing bodies vote the money.
The sentence is long enough that you stop belonging to the county and start belonging to the Commonwealth.

VADOC. Once a sentence exceeds twelve months, a person becomes state-responsible and belongs to the Virginia Department of Corrections.

Parole Board. Virginia abolished discretionary parole for felonies committed on or after January 1, 1995.

Write that down, because it is the sentence that ends most conversations about this. There is a board. There is oversight. There is a body in Richmond whose entire purpose is to look at buildings like the one you are in and say whether they are fit.

You are released into supervision that is billed monthly and revocable for a missed appointment.
They let you out and they call it freedom and then they hand you a schedule.
Report on the fifteenth. Report on the first. Test clean. Pay the fee. Keep the address current. Keep the job you cannot get because of the record they will not seal.
Probation. Probation and Parole District 21 supervises people released into the four localities, operating a main office in Fredericksburg and a sub-office in Stafford.
